These Terms of Service ("Terms") govern your access to and use of the Assured Hearts website, applications, and related services (collectively, the "Platform"). By accessing or using the Platform, creating an account, clicking "I agree," or completing a booking, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. The Platform
Assured Hearts Technologies Inc. ("Assured Hearts," "we," "us," or "our") operates a two-sided online marketplace that enables families to discover, communicate with, and book independent childcare providers. The Platform is designed for families seeking childcare aligned with faith-conscious values and expectations, including Islamic values, and for caregivers who affirm their ability to provide care consistent with those expectations. Assured Hearts operates exclusively in Canada.
1.1 Marketplace Disclaimer
Assured Hearts is a technology platform only. We do not provide childcare services, do not employ or recommend caregivers, and do not supervise or control any caregiving arrangement. All Care Services are provided by independent third-party caregivers. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between Assured Hearts and any Caregiver.
2. Definitions
- "Family" means a user seeking childcare services.
- "Caregiver" means a user offering childcare services.
- "Care Services" means childcare services arranged between a Family and a Caregiver.
- "User" means any person who accesses or uses the Platform.
- "Content" means all materials submitted or made available through the Platform.
- "Resources" means educational or informational materials offered through the Platform.
3. Eligibility
You must be legally capable of entering a binding contract in your jurisdiction and provide accurate, current, and complete information.
- Users must be at least 18 years old to create an account.
- Caregivers aged 16-17 may participate only with verified parental or guardian consent.
- The Platform is not intended for use by children.
4. Account Responsibility
You are responsible for all activity on your account and for maintaining the confidentiality of your credentials. We may suspend or terminate accounts to protect Users or the integrity of the Platform.
5. Faith-Aligned Standards
Families using the Platform are not required to be Muslim. However, Families must agree to and communicate their faith-aligned expectations. Caregivers are not required to disclose religious identity but must affirm their willingness and ability to provide Care Services consistent with the Family's communicated expectations. Assured Hearts does not assess theological compatibility. Suitability determinations are solely the responsibility of the Family.
6. Profiles, Matching & Verification
Caregivers may create profiles and submit information voluntarily. Assured Hearts may provide informational tools, including availability indicators or compatibility signals, to support discovery. These tools do not constitute recommendations or endorsements. Verification features rely exclusively on user-submitted information. "Verified" status does not imply approval, safety, or suitability. Families are solely responsible for their own due diligence.
7. Payments & Fees
Assured Hearts facilitates payments between Families and Caregivers.
- Platform fees may be up to 6% and are disclosed at checkout.
- Optional subscriptions may reduce platform fees.
- Users may not bypass Platform payment systems.
- Funds are collected by Assured Hearts and paid out to Caregivers subject to applicable policies.
8. Cancellations, Refunds & Disputes
Cancellation and refund terms are disclosed at checkout and incorporated into these Terms. Assured Hearts may, at its discretion:
- Facilitate communication between Users
- Refund platform fees
- Reverse payments not yet released
Assured Hearts does not investigate facts or determine fault and is not responsible for Care Services.
9. Resources
Resources are provided for educational purposes only and do not constitute legal, medical, or professional advice.
10. Content & Reviews
Users may post truthful, respectful reviews. We may remove Content that violates these Terms. By submitting Content, you grant Assured Hearts a non-exclusive, worldwide, royalty-free license to use it for Platform operations and marketing.
11. Safety & Reporting
Childcare involves inherent risks. If a child is in immediate danger, contact local authorities first. Reports to Assured Hearts are for documentation and platform improvement only.
12. Disclaimers & Liability
The Platform is provided "as is" and "as available." To the maximum extent permitted by law, Assured Hearts' total liability will not exceed the greater of:
- Fees paid in the prior 12 months, or
- CAD $5,000
13. Governing Law
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein.
